Use of This Web Site
Credit Packages and Subscriptions
When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. Sharing your username and password with another, unauthorized user, is expressly prohibited and may result in termination of your account without refund, at our sole discretion.
Upon creation of an account, Services are offered through Individual Packages, Individual Teacher All-Access Subscription, or Organizational Multi-Teacher Subscriptions. These packages do not expire. Individuals may also purchase a one-monthly subscription.
A valid payment method, including credit card, is required to process the payment for any Credit Packages or Subscription purchased. You shall provide us with accurate and complete billing information including full name, address including state, city, zip code, and country, and a valid payment method information. By submitting such payment information, you automatically authorize us to charge all Credit Package and Subscription fees for requested packages and subscriptions to any such payment instruments. Upon purchase of a subscription, we grant to the Purchaser a personal limited non-exclusive, non–transferable license to our content. Any Content downloaded from the website cannot be emailed, shared, posted, transferred, or distributed in any other way to another person physically or electronically without the consent of us. Any commercial use of the Service other than for teaching purposes is expressly prohibited. Any such use may result in termination of access to the Service without refund.
Daniel Calver, in its sole discretion and at any time, may modify the fees for the Packages and Subscriptions. We will provide you with a reasonable prior notice of any change in fees. Your continued use of the Service after the fee change comes into effect constitutes your agreement to pay the modified Package fee amount.
All fees paid for Content that is used are nonrefundable. All fees for Subscriptions, workshops and lesson are nonrefundable in order to protect the illegal sharing of our content. However, if a package has been purchased but credits have not been used to download content within 30 days, we will issue a refund upon request.
You agree not to post to any site, forum, or social media account of ours or otherwise transmit information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials (“Content” means the transmission of information, data, text, software, music, sound, photographs, graphics, video, messages, tags or other materials generated by a user) that:
- is patently offensive and/or promotes racism, bigotry, hatred or physical harm of any kind against any group or individual;
- harasses or advocates harassment of another person;
- exploits people in a sexual or violent manner;
- contains nudity, violence, pornography, sexually explicit material or offensive subject matter;
- provides any telephone numbers, street addresses, last names or email addresses of anyone other than your own;
- promotes information that you know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous;
- violates any intellectual property or other proprietary right of any third party, including Content that promotes an illegal or unauthorized copy of another person’s copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files;
- involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing, instant messaging, “spimming,” or “spamming”;
- contains restricted or password only access pages or hidden pages or images (those not linked to or from another accessible page);
- furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone’s privacy, or providing or creating computer viruses;
- – solicits passwords or personal identifying information from other Users;
- involves commercial activities and/or sales without our prior written consent, such as contests, sweepstakes, barter, advertising, and/or pyramid schemes;
- includes a photograph of another person that you have posted without that person’s consent or otherwise constitutes an invasion of an individual’s privacy or infringement of publicity rights;
- denigrates, ridicules, or demeans another person; or
- contains a virus or other harmful component.
You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” or “offline readers,” that accesses the web site in a manner that sends more request messages to our servers in a given period of time than a human can reasonably produce in the same period by using a conventional online web browser.
The Service, inclusive of lesson plans, methodology, workshops, lessons and its original content features and functionality are and will remain the exclusive property of ours and its licensors. The Service is protected by copyright, trademark, and other laws of the United States, United Kingdom, the Russian Federation and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ours. The third party content used by us is not the property of us and we do not grant any license thereto.
Our Service uses and may contain links to third-party web sites or services that are not owned or controlled by us.
We have no control over, and assume no responsibility for, the availability, content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services. We urge all copyright owners, to recognize that the links contained within this site are located somewhere else on the web. We does not host any of the videos shown on its website. Our Service doesn’t host any of the videos within its own server and it links to the contents uploaded by the popular Online Video hosting sites like Youtube.com, and other popular video hosts. This website links to these websites either directly or by an embed code. We cannot be held liable for content uploaded by members of third-party websites.
Any information provided to Daniel Calver by the User is truthful to the best of the User’s knowledge and in the event any such information changes, the User shall notify us of any such change within a reasonable amount of time.
